Acting President Kamala Harris?

On Thursday, February 8, Special Counsel Robert Hur released his bombshell report on President Biden.  In January 2023, Mr. Hur was appointed by US Attorney General Merrick Garland to investigate whether President Biden improperly handled sensitive, top-secret documents.  After his extensive investigation, Mr. Hur concluded that President Biden “willfully retained and disclosed classified materials after his vice presidency when he was a private citizen.”  More specifically, Mr. Hur found the following:


There are recordings showing that President Biden knew he had classified records at his home as early as February 2017.  That, of course is completely opposite of the President’s claim in January 2023 that he “immediately turned over the classified information stored at his Delaware home when the records were discovered in December 2022.


In another recording, President Biden told Mark Zwonitzer, the ghostwriter of Biden’s 2017 memoir, (Promise Me, Dad), that he had resisted turning in some of his notes to the National Archives.

President Biden knew that his ghostwriter wasn’t authorized to receive classified information, but he furnished it anyway.  In another recording, the President said to his ghostwriter: “some of this may be classified, so be careful.”


President Biden preserved his classified notes for personal profit.  “After leaving office, Mr. Biden kept his notebooks at his homes in Virginia to provide raw material for his eventual second memoir.”  We note that President Biden and his wife earned more than $15.6 million from book deals and speaking fees between 2017and 2019.

In Mr. Biden’s interview with our office, he explained that he took his notebooks with him after his vice presidency because “they are mine,” and explained that “every President before me has done the same exact thing.”


In his written answers, Mr. Biden wrote that, “like Presidents and Vice Presidents before me, I understand these notes to be my personal property.” He declined to answer several questions about whether he believed his notes contained classified information; whether he believed he was authorized to possess classified information after his vice presidency, and whether he took steps to avoid writing classified information in his notebooks. 


If this sounds like to you some of the same type of actions that former President Trump is being charge with, you’d be correct; yet Special Counsel Hur, unlike Special Counsel Smith, declined to criminally prosecute President Biden. Why?  Well, in part, because Hur found that President Biden had “Diminished Faculties in advancing age.”


The very next day, President Biden angrily responded in a press conference. He denied Hur’s description of him as a “well-meaning, elderly man with a poor memory,” and he made many obvious false statements.  On another matter, he said he addressed the Gaza situation with the President of Mexico, Abdel Fattah el-Sisi, who is actually the President of Egypt. 


That’s not the only example of Biden’s “diminished faculties.”  On Thursday, the president referred to Roe v. Wade, the Supreme Court’s landmark abortion case as “Roe v. Ward.” The day before, Biden told donors at a fundraiser about speaking with German Chancellor Helmut Kohl in 2021 at that year’s G7 Summit. (Oops!  Kohl left office in 1998 and died in 2021). Double Oops!! In Las Vegas just days before, Biden confused current French President Emmanuel Macron with former French President François Mitterrand, who died in 1996.


You don’t have to be a MAGA Republican to worry whether President Biden is now mentally competent to act as President of the United States. As Robert F. Kennedy Jr. just said: “This is a job that requires a lot of complexity, a lot of nuance, a lot of very, very difficult decisions.  He is the man that might get a phone call at 3 o’clock in the morning that your children and my children are depending on his answering it in a way in response to complexities.”


In our opinion, for some time now, it’s been visibly evident that our President has not been mentally up to the job; Mr. Hur is only confirming the obvious.  We think it is time for both Republicans and Democrats to put politics aside and act responsibly to enact the 25th Amendment.

 

Section 4 of the 25th Amendment to the US Constitution states as follows: “Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.


It's time for Acting President Kamala Harris.
